NOTICE: THESE TERMS REQUIRE MOST DISPUTES BETWEEN YOU AND AMPLIFY TRAVEL LLC TO BE RESOLVED THROUGH INDIVIDUAL, BINDING ARBITRATION IN CHARLESTON COUNTY, SOUTH CAROLINA, RATHER THAN IN COURT. BY ACCEPTING THESE TERMS, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. PLEASE REVIEW THE DISPUTE RESOLUTION AND BINDING ARBITRATION SECTION CAREFULLY.
Please read these Terms and Conditions (“Terms”) carefully before accessing the Amplify Travel website, creating an account, purchasing a membership or service, or using any products, services, booking tools, content, benefits, or features made available by Amplify Travel LLC.
In these Terms, “Amplify Travel,” “we,” “us,” and “our” refer to Amplify Travel LLC, a South Carolina limited liability company. “You” and “your” refer to the individual or business accessing or using our website or services.
By accessing our website, creating an account, making a purchase, or using an Amplify Travel service, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you may not use our website or services.
1. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or use our services.
If you use our services on behalf of a business or another organization, you represent that you have authority to accept these Terms on its behalf.
2. Amplify Travel Services
Amplify Travel may provide services including, but not limited to:
- Travel memberships and member benefits
- Access to travel-booking platforms and booking opportunities
- Rewards strategy consultations
- Business rewards strategy
- Travel-related education and information
- Concierge and travel-planning assistance
- Business travel and incentive solutions
- Promotional offers and complimentary travel experiences
- Newsletters, articles, recommendations, and other content
Specific services, benefits, prices, renewal terms, eligibility requirements, and limitations may be described on the applicable sales page, checkout page, membership materials, confirmation email, or separate written agreement. Those additional terms are incorporated into these Terms by reference.
If a specific written offer conflicts with these general Terms, the terms of the specific written offer will control for that purchase.
3. Accounts and Account Security
When creating an account, you agree to provide information that is accurate, complete, and current.
You are responsible for protecting your login credentials and for all activity conducted through your account. You may not share, sell, transfer, or permit unauthorized access to your account or membership unless Amplify Travel expressly allows it in writing.
You must notify us promptly at [email protected] if you become aware of unauthorized access, a security breach, or misuse of your account.
We may suspend or terminate an account if the information provided is inaccurate, the account is used fraudulently, these Terms are violated, or continued access creates a security, legal, or operational risk.
4. Memberships, Fees, and Payments
Prices, payment schedules, membership periods, renewal terms, and included benefits will be disclosed at or before checkout.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize Amplify Travel LLC or its payment processor to charge the stated amount.
Unless expressly stated otherwise in writing:
- Membership and service fees paid to Amplify Travel LLC are nonrefundable.
- Memberships and benefits have no cash value.
- Unused benefits are not redeemable for cash or account credit.
- Benefits may not be resold, transferred, or used for commercial resale.
- Third-party taxes, resort fees, booking fees, transportation charges, deposits, and incidental expenses are not included unless specifically stated.
- You remain responsible for charges imposed by travel suppliers and third-party booking providers.
Nothing in this section limits any cancellation or refund right that cannot legally be waived.
5. Membership Benefits and Availability
Membership benefits, discounts, booking availability, promotional offers, and complimentary travel experiences may be subject to availability, blackout dates, destination restrictions, advance-booking requirements, occupancy requirements, taxes, supplier rules, or other conditions.
Examples of potential savings or discounts are illustrative and do not guarantee that every member, reservation, destination, or travel date will receive the maximum advertised discount.
Travel inventory, pricing, availability, and supplier terms may change without notice. Amplify Travel does not guarantee that a particular hotel, destination, itinerary, price, benefit, or travel date will be available.
Amplify Travel may modify, replace, discontinue, or improve membership features when reasonably necessary. We will not intentionally eliminate the fundamental value of a paid membership without providing an appropriate substitute or remedy when required by applicable law.
6. Third-Party Booking Platforms and Travel Suppliers
Amplify Travel may provide access or links to booking platforms, hotels, resorts, airlines, cruise lines, rental-car companies, tour operators, payment processors, rewards programs, and other independent third parties.
These third parties are separate businesses and are not employees, agents, partners, or controlled entities of Amplify Travel LLC. Providing a link, booking connection, recommendation, or membership benefit does not mean Amplify Travel owns or controls the third party.
Travel reservations and related transactions may be entered into directly between you and the applicable booking platform or travel supplier. Those transactions are governed by the third party’s terms, cancellation policies, refund rules, privacy practices, availability requirements, and operating policies.
Amplify Travel LLC is not responsible for the acts, omissions, financial condition, errors, cancellations, delays, overbookings, service failures, schedule changes, lost baggage, property conditions, injuries, refunds, credits, bankruptcies, or other conduct of a third-party booking platform or travel supplier.
Disputes involving a third-party reservation, supplier charge, cancellation, refund, property, transportation service, or travel experience must generally be addressed directly with the applicable booking provider or supplier.
You are responsible for reviewing all reservation details and third-party terms before completing a booking.
7. Travel Risks and Customer Responsibilities
Travel involves risks outside Amplify Travel’s control. You are responsible for:
- Reviewing passport, visa, identification, and entry requirements
- Confirming health, vaccination, insurance, and safety requirements
- Checking schedules, reservation details, and travel documents
- Obtaining suitable travel insurance when appropriate
- Evaluating governmental advisories and destination conditions
- Complying with supplier rules and applicable laws
- Paying taxes, fees, deposits, gratuities, and incidental charges not expressly included
Amplify Travel does not guarantee entry into any country, the safety of any destination, uninterrupted travel, favorable weather, supplier performance, or reimbursement for interrupted or cancelled travel.
8. Rewards Strategy and Educational Information
Rewards strategy consultations, articles, newsletters, recommendations, and other Amplify Travel content are provided for educational and informational purposes.
Amplify Travel does not provide legal, tax, accounting, investment, or individualized financial advice. We do not guarantee approval for any credit card, loan, rewards program, status level, credit limit, welcome offer, redemption, or other financial product or benefit.
Credit-card issuers, banks, loyalty programs, and travel partners independently determine eligibility, approvals, account terms, rewards valuations, bonus qualification, program changes, and account closures.
You are solely responsible for evaluating whether a financial product, credit application, rewards strategy, or redemption is appropriate for you. You should consult an appropriately licensed professional regarding legal, tax, accounting, credit, or financial matters.
9. Complimentary and Promotional Travel Benefits
A complimentary or promotional travel experience may be subject to separate eligibility requirements, redemption instructions, supplier terms, expiration dates, destination options, availability, taxes, booking fees, resort fees, transportation expenses, or other disclosed limitations.
Unless expressly stated in writing, “complimentary” refers only to the specifically identified accommodation or travel component. It does not include airfare, transportation, meals, taxes, deposits, resort fees, gratuities, or incidental expenses.
Failure to complete redemption requirements or redeem a benefit before its stated expiration date may result in forfeiture of that benefit.
10. Acceptable Use
You agree not to:
- Use our website or services for unlawful, fraudulent, abusive, or deceptive purposes
- Attempt to gain unauthorized access to an account or system
- Interfere with the operation or security of our website
- Copy, scrape, reproduce, resell, or commercially exploit our content or services without permission
- Misrepresent your identity, eligibility, business, or payment information
- Use membership benefits for unauthorized resale or third-party commercial activity
- Submit false claims, chargebacks, or payment disputes
- Violate the rules of a booking platform, travel supplier, payment processor, or rewards program
We may investigate suspected misuse and suspend or terminate access when reasonably necessary.
11. Intellectual Property
The Amplify Travel name, logos, website design, text, graphics, membership materials, consultation materials, strategies, videos, downloads, and other original content are owned by or licensed to Amplify Travel LLC and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use our website and purchased materials for your personal or internal business use.
You may not reproduce, distribute, publish, modify, sell, sublicense, create derivative works from, or commercially exploit our intellectual property without our prior written permission.
12. Electronic Communications
By providing your email address or telephone number, you agree that we may send transactional communications relating to your account, purchases, membership, consultations, reservations, or customer service.
You may unsubscribe from marketing emails by using the unsubscribe link included in the message. Unsubscribing from marketing communications does not prevent us from sending necessary transactional or account-related notices.
13. Suspension and Termination
Amplify Travel may suspend or terminate access to an account, membership, or service if you:
- Violate these Terms
- Engage in fraud, abuse, harassment, or unauthorized resale
- Fail to make a required payment
- Misuse a booking platform, benefit, or promotional offer
- Create a security or legal risk
- Engage in conduct that could harm Amplify Travel, its members, or its partners
Upon termination, your right to use the applicable service immediately ends.
Provisions concerning payment obligations, intellectual property, disclaimers, third-party providers, indemnification, limitations of liability, arbitration, and other provisions that logically should survive termination will remain in effect.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, MEMBERSHIPS, SERVICES, CONTENT, RECOMMENDATIONS, AND BENEFITS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
AMPLIFY TRAVEL LLC DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND COURSE OF PERFORMANCE.
WE DO NOT WARRANT THAT THE WEBSITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS. WE DO NOT GUARANTEE ANY PARTICULAR SAVINGS, TRAVEL RESULT, REWARDS OUTCOME, BUSINESS RESULT, FINANCIAL RESULT, OR THIRD-PARTY PERFORMANCE.
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMPLIFY TRAVEL LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOST OPPORTUNITIES, LOSS OF DATA, LOSS OF GOODWILL, OR THE COST OF SUBSTITUTE TRAVEL OR SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF AMPLIFY TRAVEL LLC FOR ANY CLAIM ARISING OUT OF OR RELATING TO A PARTICULAR AMPLIFY TRAVEL MEMBERSHIP, CONSULTATION, OR OTHER SERVICE WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID DIRECTLY TO AMPLIFY TRAVEL LLC FOR THE SPECIFIC MEMBERSHIP OR SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
THE LIABILITY CAP APPLIES ONLY TO FEES PAID DIRECTLY TO AMPLIFY TRAVEL LLC. IT DOES NOT INCLUDE OR REFER TO AMOUNTS PAID TO A HOTEL, AIRLINE, CRUISE LINE, RESORT, RENTAL-CAR COMPANY, TOUR OPERATOR, BOOKING PLATFORM, PAYMENT PROCESSOR, FINANCIAL INSTITUTION, OR ANY OTHER THIRD PARTY. AMPLIFY TRAVEL LLC DOES NOT ASSUME LIABILITY FOR THOSE THIRD-PARTY AMOUNTS, BOOKINGS, PRODUCTS, OR SERVICES.
These limitations apply regardless of the legal theory asserted and even if Amplify Travel LLC was advised that damages were possible. They do not apply to liability that cannot lawfully be excluded or limited.
16. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Amplify Travel LLC and its owners, officers, employees, contractors, affiliates, and representatives from claims, liabilities, damages, judgments, losses, and reasonable costs arising from:
- Your violation of these Terms
- Your unlawful or unauthorized use of our services
- Information or content you submit
- Your misuse or resale of a membership or benefit
- Your violation of a third party’s rights
- A reservation or transaction you independently complete with a third party
This provision does not require you to indemnify Amplify Travel LLC for liability caused solely by its own unlawful conduct when such indemnification is prohibited by law.
17. Informal Dispute Resolution
Before initiating arbitration, the party asserting a dispute must provide the other party with written notice describing:
- The party’s name and contact information
- The relevant account, membership, purchase, or service
- The facts supporting the dispute
- The specific relief requested
Notices to Amplify Travel LLC must be sent to [email protected] with the subject line “Notice of Dispute.”
The parties will attempt in good faith to resolve the dispute informally for at least 30 days after receipt of the notice. If the dispute is not resolved during that period, either party may initiate arbitration.
18. Binding Arbitration and Class-Action Waiver
Except for a claim that qualifies for individual small-claims court or a request for temporary injunctive relief concerning unauthorized use of intellectual property, any dispute, claim, or controversy arising out of or relating to these Terms, the website, a membership, a consultation, an Amplify Travel service, or the relationship between you and Amplify Travel LLC will be resolved through final and binding arbitration.
The arbitration will be conducted by a single neutral arbitrator in Charleston County, South Carolina. Unless the parties agree otherwise, the arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules or Commercial Arbitration Rules, depending on the nature of the transaction.
These Terms involve interstate commerce, and the Federal Arbitration Act will govern the interpretation and enforcement of this arbitration provision. To the extent South Carolina arbitration law also applies and is not preempted, the South Carolina Uniform Arbitration Act will apply.
The arbitrator may award any individual remedy that would be available in a court of competent jurisdiction, subject to the valid limitations contained in these Terms. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in a court with jurisdiction.
ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY. NEITHER YOU NOR AMPLIFY TRAVEL LLC MAY PARTICIPATE IN A CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTION OR ARBITRATION. THE ARBITRATOR MAY NOT COMBINE THE CLAIMS OF MORE THAN ONE PERSON WITHOUT THE WRITTEN CONSENT OF ALL PARTIES.
If the class-action waiver is held unenforceable as to a particular claim or request for relief, that claim or request will be decided by a court of competent jurisdiction and not through class arbitration.
19. Governing Law
These Terms and any dispute not subject to arbitration will be governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
Any legal proceeding permitted under these Terms relating to enforcement of the arbitration provision, confirmation or review of an arbitration award, a qualifying small-claims matter, or authorized court relief must be brought in a court of competent jurisdiction located in Charleston County, South Carolina, unless applicable law requires otherwise.
20. Changes to These Terms
Amplify Travel LLC may modify these Terms when reasonably necessary to reflect changes in our services, business practices, third-party relationships, or applicable law.
Revised Terms will be posted with an updated effective date. When legally required, we will provide additional notice of a material change.
Changes will apply prospectively. Your continued use of the website or services after revised Terms become effective constitutes acceptance of the revised Terms.
21. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
22. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.
23. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
Amplify Travel LLC may assign these Terms in connection with a merger, acquisition, sale of assets, corporate reorganization, financing, or transfer of the Amplify Travel business or brand.
24. Entire Agreement
These Terms, together with the applicable sales page, checkout terms, membership description, Privacy Policy, confirmation materials, and any separate written agreement between you and Amplify Travel LLC, constitute the entire agreement concerning the applicable services.
They supersede prior or contemporaneous communications concerning those services.
